Risk Acceptance Agreement

By booking with Loving Surf for any or all services you acknowledge, understand and agree upon below terms and conditions fully and waive any and all claims you may have against Loving Surf.


This document is construed in accordance with the English Language and in case of any conflict between the English Language version of this document and any translation; the English Language version shall take precedence and shall prevail.


References to Loving Surf include its partners, officers, employees, members, servants and/or agents. References to “claims” include any claims for any type of damages, compensation, costs (including legal costs), awards and/or any other form of loss and/or liability. References to “liability” include any liability in contract, for breach of any duty of care, under any legislation and/or under any other legal basis.

Safety and Insurance

I confirm and fully disclosed to Loving Surf of any injury, disability, allergy, medical and/or health condition (whether past or current) before arrival. I understand failing to do so may increase the risk of injury. I declare that I am medically and physically fit and able to participate in the services and will notify Loving Surf of any change to my medical condition, fitness or ability to participate.
Surfing is inherently dangerous. Injury and/or death may result from water hazards, other surfers, underwater hazards and marine life and other risks which I may be exposed to while surfing. I understand and acknowledge the risks which are associated with surfing. I acknowledge that accidents can and do happen which may result in me being injured or even killed. I have voluntarily read and understood this warning and accept these risks.
Loving Surf accepts no responsibility for any liability, public liability or accident liability, under any service offered by Loving Surf including lessons and surf guiding for its clients. You accept that accidents happen and that Loving Surf is not responsible in any way for any injury, death, or loss/damages of belongings. Therefore it is highly recommend that you take out travel and medical individual insurance before arrival.
Loving Surf cares for your personal safety and advice in order to avoid injury or risk. In booking our services you agree to listen carefully to all instructions for your own safety and for the safety of other people.
Loving Surf offers sets up non-mandatory insurance that prevent extra costs in event of damages to surf equipment:

Property insurance: 30 € / person

Covers eventual unwitting damages on any items belonging to Loving Surf. In case of damage, no additional fees will be charged.
The underwriting (subscription) of those insurances does not exempt the client to its obligations. The respect of safety instructions, as well as the good treatment of any equipment is required. Loving Surf will show to its clients how to take care of the equipment and will explain the rules of priority on the surf spots.
In the case of non-subscription to these insurances, of non-compliance of safety rules and/or in the case of intentional degradation of the equipment (even if the client subscribed to the insurance), Loving Surf reserves the right to ask the accused, the immediate payment or the full reimbursement of expenses incurred. It is the decision of Loving Surf to define the amount of the repair cost or replacement of the equipment. Defined from the price of the local market and the expertise of our suppliers / shapers, this amount is non-negotiable.

Booking and Cancellation

These are the conditions applicable to holidays and lessons booked with Loving Surf and should be read carefully.
The booking of the stay is confirmed on receipt of the deposit (20%). The remaining amount is payable upon arrival to Loving Surf in cash (euros or equivalent in dirhams). Exchange rate is based on date of payment of final price. Loving Surf has the right to alter or adjust pricing, please check price at time of booking. All prices, unless specified otherwise, are in euros. We are not responsible for any fees incurred due to currency exchange or fees charged by your credit card/bank for processing payment in either currency. Furthermore, we are not responsible for extra fees charged by third party. 
Once the booking deposit has been paid, no refund can be done in case of cancellation. If the cancellation is done more than 1 month before the scheduled date, it is possible to keep the deposit paid for a next stay. If the cancellation occurs after this month delay, the deposit is kept by Loving Surf as compensation. Loving Surf does not offer refund if the customer is indisposed during his stay (injury / illness).
Loving Surf does its best to offer you the best conditions to surf. Nevertheless, we are not responsible of the climatic conditions. In the rare cases where the conditions do not allow us to surf, no refund will be granted to compensate for the surf, yoga or any other activity organized by Loving Surf or third party suppliers. On the other hand, we will propose you alternative activities. Loving Surf is not required to offer you a refund.
If a member of the team Loving Surf is not able to fulfill its functions, we guarantee that we will do our best to substitute another qualified surf coach.
Alterations to your holiday by Loving Surf: It is unlikely that we will have to make any changes to your holiday, but occasionally small changes may be made, which we reserve the right to do at any time. Most of these changes are minor and we will advise you at the earliest possible date.
If a customer wants to change the details of his trip (dates, schedules, reserved activity or package) it is the decision of Loving Surf to decide if, yes or no, the change is possible, and under what pricing conditions.
If a customer is acting in a disruptive manner, behaving irresponsibly, with violence or disrespectful attitude towards another person, the furniture or equipment placed at its disposal, Loving Surf has the right to ask him to leave immediately. In this case, it is the responsibility of Loving Surf to decide if, yes or no, a refund may be granted. This decision is non-negotiable.


Loving Surf may act as an agent in the arrangement of travel services and accepts no liability for any injury, loss, damage, accident, delay, irregularity or costs incurred that may arise to any passenger or third party resulting from the passengers or third party’s use. Some of our service providers (e.g. Transfer Companies ) will have additional booking conditions. As agents for these providers we do not take responsibility for any omission, default, neglect or accuracy of any information or statement made by them. Some service providers may require additional booking forms to be completed in order for the reservation to be completed.

Personal Belongings

Our team is very attentive to your safety in and out of the water. We guarantee you to do our best in order to take you in safe surf spots and places.
The customer is responsible to take care of his personal effects within the establishment as well as on the places of activities. Loving Surf does not take the responsibility on the personal effects of customers, even in the event of a theft or deterioration. We recommend you to take care of your personal effects at any time and leave the objects of value in your rooms.


I agree that photographic, video and/or sound recordings in any medium made by Loving Surf of my participation in their services may be used for the general promotion of Loving Surf including in printed copy and via the internet, without financial compensation. If you do not want your photos or videos to be used, please mention it expressly as soon as th confirmation of your stay is done.


The data that we collect through our web site are strictly reserved for our own use and will not be shared with any other public or private entity. We do not sell or give any information concerning our customers to external sources. If you wish to correct, update or delete any information concerning you, within our system, send us the details of your request to info@lovingsurf.com
Our IT servers, identify your IP address and work with others to assist us in the maintenance and improvements of our computer tools. This information is transmitted in the form of anonymous statistics, in order to establish the rates of associates the higher of the day or week, the pages containing errors, and to determine the effectiveness of our marketing. This information is in no case used, for other things.


Images and content on Loving Surf website are protected by copyright and must not be copied, saved or used in any format other than your permitted use of this site. Tradmarks and logos displayed on this website are the property of Loving Surf and users are prohibited from usage without expressed consent.


Loving Surf makes no warranty or representation in regards to the activity provided as published on the website. Loving Surf has no liability for any act, omission or default, whether negligent or otherwise casued by any activity supplier. Loving Surf is not liable to you or any other person for any injury, damage or loss however caused in connection to the use of website or linked website by undertaking an activity booked on the website.

When making a payment, you will be accepting the Privacy Policy of our payment system provider Paypal.
Your data may be used to ensure Paypal provides Loving Surf and its customer’s payment processes of the highest security and quality.
Please be assured no personal details will be shared outside of Paypal and Loving Surf.
By signing up to our newsletter communications, you will be accepting the Privacy Policy of our mailing system provider MailChimp. MailChimp has extensive and high-quality systems to protect your personal details and will never sell email addresses or mailing lists that Loving Surf uses for its email communication and marketing.  
When guests sign up to our Wi-Fi network, you will be accepting the Privacy Policy of our internet provider, Maroc Telecom.
Please be assured that your data is only kept within these trusted and secure providers. We do not store your information within an internal database system. Loving Surf will only communicate with clients via phone, SMS and email who have explicitly given their consent to use their data in this manner.

Our Services will be governed by and construed in accordance with the laws of Morocco. All disputes, controversies, or claims arising out or in connection with the use of our Services shall be submitted to and be subject to the jurisdiction of the courts of the country of Morocco.
