TERMS AND CONDITIONS

The conditions herein apply to any reservation, service, activity, accommodation, transport, and or itinerary booked with Loving Surf and or any independent third party provider, but not limited to. Loving Surf will do their utmost to be of service to all their clients and may offer additional and or alternative services, activities, accommodations, and prices to meet each client’s expectations. We do not guarantee the availability of any activities published on our website.

LANGUAGE

This document is construed in accordance with the English Language and in case of any conflict between the English Language version of this document and any translation; the English Language version shall take precedence and shall prevail.

DEFINITION

References to Loving Surf include its partners, officers, employees, members, servants and/or agents. References to “claims” include any claims for any type of damages, compensation, costs (including legal costs), awards and/or any other form of loss and/or liability. References to “liability” includes any liability in contract, for breach of any duty of care, under any legislation and/or under any other legal basis.

RESERVATIONS, PAYMENTS AND CANCELLATION POLICY

Any reservation booked through Loving Surf is confirmed upon receipt of a 10% deposit. The balance and or full payment is due upon your arrival. All prices, unless otherwise specified, are in EUROS and dirhams. WE convert EUROS to dirhams based on 1 EUR = 11 MAD. Currency exchange rate, transaction fees and any bank incurred fees are not the responsibility of Loving Surf, and are based on the date of payment(s). Loving Surf has the right to alter or adjust pricing, please check prices at the time of booking. Loving Surf is not responsible for extra fees charged by third parties. All deposits are non-refundable. Payments made in full are non-refundable. Loving Surf does not offer refunds if the customer is indisposed during his or her stay due to injury or illness. In the case of weather disruptions to Lessons, alternative activities will be provided at the same or lesser value of cancelled lesson. Or we can offer higher value services to provide same value of payment, for example a private lesson in place of group. We aim to provide the best experience possible, however we are a business. Any price adjustment are left at the discretion of Loving Surf Management.

MODIFICATION

It is unlikely that we will alter, discontinue, cancel or terminate any service, activity and or accommodation booking, however, Loving Surf reserves the right to do so at any time with or without notice, for any reason whatsoever. We will advise you at the earliest possible date.

If a customer wants to change the details of his or her trip (dates, schedules, reserved activity or package, etc) it is at the discretion of Loving Surf to modify and at what pricing terms. "Regular Pricing" is stated on the website and subject to change.

SAFETY

Upon booking, clients and students confirm and fully disclosed to Loving Surf of any injury, disability, allergy, medical and/or health condition (whether past or current) before or upon arrival. Failure to do so may increase the risk of injury. Students are assumed to be medically and physically fit and able to participate in the services and expected to notify Loving Surf of any change to my medical condition, fitness or ability to participate.

Surfing is inherently dangerous. Injury and/or death may result from water hazards, other surfers, underwater hazards and marine life and other risks, students may be exposed to while surfing. Students understand and acknowledge the risks which are associated with surfing. Accidents can and do happen which may result in being injured or even killed. Students voluntarily read and understand this warning and accept these risks. Loving Surf accepts no responsibility for any liability, public liability or accident liability, under any service offered by Loving Surf including lessons and surf guiding for its clients. Medical Travel insurance is highly recommended and the responsibility of each student. Any medical costs in association to lessons or rentals are that of the student.

Loving Surf cares for your personal safety and advice in order to avoid injury or risk. In booking our services you agree to listen carefully to all instructions for your own safety and for the safety of other people.

Loving Surf offers sets up non-mandatory insurance that prevent extra costs in the event of damage to surf equipment. Please inquire if interested. Damage costs are at the discretion of Management and team on individual basis.

INSURANCE AND LIABILITY

Loving Surf may act as an Agent in the arrangement of travel services and accepts no liability for any injury, loss, damage, accident, delay, irregularity or costs incurred that may arise to any passenger or third party resulting from the passengers or third party’s use. As Agents for these providers, Loving Surf has no liability for any act, omission, accuracy of service description and or default, whether negligent or otherwise caused by any supplier. Loving Surf is not liable to you or any other person for any injury, damage or loss whatsoever caused in connection with the use of the website, linked website(s), service, accommodation and or activity available to you through Loving Surf.

Some of our service providers (e.g. Transfer Companies, Quad, car rental services ) will have additional booking conditions and may require additional booking forms to complete the reservation. Loving Surf does not guarantee or represent any activity or service provided by any third party supplier.

In the case of a member of the Loving Surf Team is unable to fulfill his or her function and or duty, we guarantee that we will do our best to substitute another qualified representative.

Prior to your arrival, we highly recommend securing Medical and Travelers Insurance, it is the client’s responsibility.

LACK OF AVAILABILITY

We cannot accept any liability if a booked activity session is unavailable, we simply enable reservations from the quantity supplied by each supplier, on a first-come, first-serve basis.

INCLEMENT WEATHER

Loving Surf and or any independent third party supplier is not responsible for any activity or accommodation being altered or cancelled due to bad weather conditions. Loving Surf and or the independent third party is not required to offer you a refund.

CONDUCT

Loving Surf has a no tolerance policy for disruptive, irresponsible, violent or disrespectful behavior towards another person. Loving Surf takes no liability for theft and inappropriate use or damage to furnishings and or equipment. Loving Surf has the right to ask any person(s) to leave immediately upon misconduct.

PERSONAL BELONGINGS

The customer is responsible to take care of his or her personal effects within the establishment as well as the place(s) of activities. Loving Surf does not take the responsibility on the personal effects of customers, even in the event of a theft or deterioration. We recommend you to take care of your personal effects at any time and leave the object(s) of value in your rooms.

Trademarks and logos (“marks”) displayed on this website are proprietary of Loving Surf and users are prohibited from using without the expressed consent from BrandSolutions and or Loving Surf Essaouira.

These Terms and Conditions do not affect a The Consumer Rights Act.
